your e-mail marketing preferences;

We use your personal information to deliver services or carry out transactions you have requested, such as providing information on United Furniture products, registering purchased products, processing product orders, handling warranty claims, replacing product manuals, answering customer service requests, facilitating use of our websites, and so forth. Website improvement. We may use your personal information to improve our websites and related United Furniture products or services, or to make our websites easier to use by eliminating the need for you to repeatedly enter the same information or by customizing our websites to your particular preference or interests.

Except as described below, personal information you provide to United Furniture through our websites will not be shared outside of United Furniture and its controlled subsidiaries and affiliates without your permission.

United Furniture contracts with other companies to provide services on our behalf, such as hosting websites, sending out information, processing transactions, and analyzing our websites. We provide these companies with only those elements of your personal information they need to deliver those services. In those cases, we provide these companies with only those elements of your personal information they need to respond to your request, and these companies and their employees are prohibited from using that personal information for any other purpose. However, we will not share your information for such marketing purposes unless we have obtained your express consent to do so.

For example, we store the personal information you provide on computer systems with limited access that are located in facilities to which access is limited. For sites to which you login, it is your responsibility to ensure the security of your password and not to reveal this information to others. When you move around a site to which you have logged in, or from one site to another that uses the same login mechanism, we verify your identity by means of an encrypted cookie placed on your machine.

In some cases, you can review and correct personal information provided through our websites by going to the page on which you provided the information. United Furniture does not knowingly collect information from children and does not target or direct its websites to children.

We also link to third-party providers that host, maintain and operate on-line training curricula. While we try to link only to sites that share our high standards and respect for privacy, we are not responsible for the content, security, or privacy practices employed by other sites.

United Furniture may occasionally update this privacy statement. When we do, we will revise the "last updated" date at the top and bottom of the privacy statement. We will obtain your opt-in consent for any updates to this privacy statement that materially expand the sharing or use of your personal information in ways not disclosed in this privacy statement at the time of collection.

 

CONDITIONS OF SALE

 

Cancellation: Cancellation of an order must happen within 10 days after placing the order to avoid cancellation fees. During this 10-day-grace period, orders can be cancelled at the store via a special cancellation form. After the 10th day of placing the order this contract is binding and can only be cancelled in writing by registered letter. The date of Post Office stamp will be used as proof of cancellation. Telephone calls or any other type of verbal communication will not be accepted method of cancellation and are meaningless. The Seller has the right to charge the following fees in case of cancellations after the 10-day-Grace period: 25% of the sales price for all special order items (A SPECIAL ORDER is any item that is not in stock and has to be ordered from the factory as to Buyer’s request) and 10% of sales price for stock orders.

Price as marked is fixed. Extras not included in price are to be charged separately. Errors in pricing due to sales person’s error will be corrected by office. Official price list will prevail in case of dispute. J&M FURNITURE GmbH can refuse an order if no agreement can be reached in case of a price dispute.

The Seller is not responsible for minor changes made by the manufacturer and such changes cannot be used as a reason for cancellation.

Delivery service is at the option of the Seller. Delivery fee is never refunded in case of non-acceptance. Pick up of merchandise will be charged the same as delivery fee.

Delivery Time: In case the Seller cannot keep commitment due to unforeseen circumstances, the buyer has the right to give notice in writing of a final delivery date. The Seller has then to deliver within 8 weeks from the date the notice is received. Buyer has the right to a refund or cancellation only after Seller is not able to deliver within this 8 weeks’ notice.

Property Ownership: The merchandise remains property of the Seller until all the liabilities of the Buyer resulting from this contract have been fulfilled. Until then, the Buyer is responsible for the proper handling and care of the goods still belonging to the Seller.

Refusal: Refusal of an order must happen within 10 days after placing the order to avoid charges. In case Buyer refuses an order after the 10 days, the Seller has the right to charge the following fees: 25% of the sales price for all special order items (A SPECIAL ORDER is any item that is not in stock and has to be ordered from the factory as to Buyer’s request) and 10% of sales price for stock orders.

All special orders require a non-refundable down payment of 25% of purchase price. (All items not appearing in our catalogue are considered special orders).

Seller can cancel the order if factory cancels production, or if delivery is hampered due to unforeseen circumstances.

Complaints that are frivolous (complaints that are in the nature of furniture over which seller no influence has) can be rejected by Seller. For complaints that originate due to damages caused by Buyer, i.e. improper handling of the furniture, Seller cannot be made liable. After 30 days liability of Seller stops for all merchandise delivered. After 7 days after delivery liability stops for obvious damages which should have been noticed on delivery. Seller’s liability stops immediately on any merchandise moved by transportation from one location to another by transporters other than Seller.

Changes or special instructions to the sales contract are only valid if in writing. Sales person’s promises to Buyer must be always written on the sales contract and verified by J&M FURNITURE GmbH to be valid.I

In case of a dispute between parties or a pursuit for payment, only the courts of Höhfröschen, Germany are qualified to intervene. Only the German Law is applicable.
